How do I know if I’m owed unpaid wages in California?
At Haulk & Herrera LLP, we help employees review their pay records to see if their employer has failed to pay minimum wage, overtime, or meal and rest break premiums. If you’ve worked off-the-clock, missed breaks, or haven’t been paid overtime, you may have a claim under California Labor Code.
My employer won’t pay me overtime. What can I do?
If you’re eligible for overtime under California law and your employer refuses to pay, you can file a wage claim or lawsuit. Our attorneys can evaluate your situation, calculate unpaid wages, and take legal action if needed.
Can I still get my final paycheck if I quit without notice?
Yes. California law requires your final paycheck to be given immediately if you are terminated, or within 72 hours if you quit without notice.
How do I know if I’m being paid correctly under California law?
You should be paid at least the state minimum wage, plus overtime for hours over 8 in a day or 40 in a week, and receive required meal and rest breaks. If you’re missing pay or breaks, you may have a claim.
What is the California overtime law in 2025?
California requires employers to pay 1.5x your regular rate after 8 hours in a day or 40 in a week, and 2x after 12 hours in a day. Haulk & Herrera LLP regularly handles cases where employers misclassify workers or fail to pay proper overtime.
What can I do if my employer denies me meal or rest breaks?
If your employer denies you meal or rest breaks, you can sue under California law. You may be owed one extra hour of pay for each day a break was denied. Haulk & Herrera LLP can help you recover this pay and hold your employer accountable.
What legal options do employees have for wage theft in San Francisco?
Haulk & Herrera LLP can help you recover unpaid wages through several legal paths, including filing a claim with the California Labor Commissioner, pursuing a Berman hearing, bringing a Private Attorneys General Act (PAGA) action, or filing a class action lawsuit if multiple employees are affected. We will evaluate your case, guide you through the process, and fight to recover the wages and penalties you are owed.
